Terms of Service

These Terms of Service ("Terms") govern your access to and use of socialgraffa (the "Service"), operated by Tyga.Cloud Ltd ("we", "us", "our"). socialgraffa is a division of Tyga.Cloud Ltd. By creating a tenant, generating an API key, or otherwise using the Service, you agree to these Terms.

1. Accounts & tenants

The Service is multi-tenant. Signing up creates a tenant and its first API key with no card required. You are responsible for all activity that occurs under your tenant, including activity performed by AI agents you configure with your credentials. You must provide accurate information and keep your credentials secure.

2. Acceptable use

You agree not to use the Service to:

• collect analytics on individuals in violation of applicable law or without a lawful basis;
• send data you are not authorised to process, or that infringes the rights of others;
• attempt to access another tenant's data, or to circumvent tenant isolation, quotas, or rate limits;
• reverse engineer, resell, or provide the Service to third parties except as expressly permitted;
• transmit malware, or use the Service to disrupt or overload our infrastructure.

3. API keys & ingest keys

A tenant API key (tga_...) is pinned to your tenant and grants access to your data. Server-side event ingest uses a separate per-website ingest key, scoped to a single website so it can only ever write that site's traffic. Key plaintext is shown once and only its hash is stored; you are responsible for storing and rotating keys. You may revoke keys at any time.

4. Plans, billing & usage

The Service offers a Free plan and paid plans. Paid plans are purchased via Stripe Checkout; an agent may request a checkout URL, but only a human can complete payment. Each plan grants quotas (websites, monthly event volume, data retention, and seats). Some plans are metered by event volume. The Free plan and any plan without a configured price are not purchasable. Fees are non-refundable except where required by law. We may change prices with reasonable notice; changes do not affect the current billing period.

5. Your data

You retain all rights to the analytics data you collect through the Service ("Your Data"). You grant us a limited licence to host, process, and transmit Your Data solely to provide the Service. Our handling of personal data is described in our Privacy Policy. Data retention follows your plan; data may be deleted after your retention window or after account termination.

6. Availability & changes

The Service is provided on an evolving basis and interfaces may change. We aim for high availability but do not guarantee uninterrupted service. Error codes, once published, are not reworded, because agents branch on them.

7. Intellectual property

The Service, including the tga CLI, the MCP server, and all related software and documentation, is proprietary to Tyga.Cloud Ltd and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Tyga.Cloud Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms or non-payment. On termination, your right to use the Service ceases and we may delete Your Data after any applicable retention period.

11. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory local law provides otherwise.
